This Privacy Policy describes how Mitchell Clinic (“Mitchell Clinic,” “we,” “us,” or “our”) collects, uses, and protects information when you visit or interact with http://www.mitchellclinic.com (the “Site”). This Privacy Policy applies to information collected through the Site itself. It does not replace, and is separate from, our HIPAA Notice of Privacy Practices, which governs how we handle Protected Health Information (“PHI”) collected in the course of providing clinical care (see Section 6 below).

We may collect the following categories of information when you use the Site:

a. Information You Provide Directly

  • Contact details you submit through a contact form, such as your name, email address, and phone number;
  • Information you submit when requesting or scheduling an appointment, which may be collected directly by us or by a third-party scheduling platform (currently ChiroUp/HealthCom);
  • Any other information you choose to include in a message to us.

b. Information Collected Automatically

  • Standard technical information such as IP address, browser type, device type, referring page, and pages visited, typically collected via cookies, log files, or analytics tools;
  • Usage data that helps us understand how visitors interact with the Site.

2. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and requests submitted through the Site;
  • Facilitate and confirm appointment requests;
  • Improve the Site’s content, usability, and performance;
  • Maintain the security and proper functioning of the Site;
  • Comply with applicable legal obligations.

We do not sell your personal information to third parties.

3. Third-Party Service Providers

We work with third-party services to operate certain features of the Site and to communicate with patients, including:

  • Online appointment scheduling (currently ChiroUp, via our scheduling page at schedule.healthcom.io);
  • Patient text messaging, appointment reminders, and online review collection/display (currently Aloha);
  • Website hosting and content management (WordPress);
  • Website analytics tools, if enabled.

These third parties may collect and process information according to their own privacy policies. We encourage you to review the privacy policies of any third-party platform you interact with through links on our Site or through text messages you receive from us. We enter into appropriate agreements with vendors who handle patient health information on our behalf, as required by law.

4. Text Messaging and Appointment Reminders

If you provide us with your mobile phone number, we may use a third-party platform (currently Aloha) to send you appointment reminders, practice updates, and requests to leave an online review, by text message (SMS). Message and data rates may apply. You may opt out of receiving text messages at any time by replying “STOP” to any message, or by notifying our office directly. Opting out of text messages will not affect the healthcare services we provide to you.

As described in our HIPAA Notice of Privacy Practices, you also have the right to request that we contact you regarding appointment reminders by an alternative method or not at all.

5. Cookies and Tracking Technologies

The Site may use cookies and similar tracking technologies to enhance your browsing experience and to gather analytics about Site usage. You can control or disable cookies through your browser settings; please note that disabling cookies may affect the functionality of certain features of the Site.

6. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information submitted through the Site. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Protected Health Information and HIPAA

If you are or become a patient of Mitchell Clinic, information related to your healthcare — including information collected during appointment scheduling, intake, or treatment — may constitute Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”). Our collection, use, and disclosure of PHI is governed by our separate HIPAA Notice of Privacy Practices, available at mitchellclinic.com/hipaa-notice-of-privacy-practices/ and provided to patients in our office. In the event of any conflict between this Privacy Policy and our HIPAA Notice of Privacy Practices regarding the handling of PHI, the HIPAA Notice of Privacy Practices controls.

8. Data Retention

We retain information collected through the Site for as long as necessary to fulfill the purposes described in this Policy, or as required by applicable law, including applicable medical recordkeeping requirements.

9. Your Rights and Choices

Depending on your location and applicable law, you may have rights regarding your personal information, such as the right to request access to, correction of, or deletion of certain information we hold about you. To make such a request, please contact us using the information in Section 12 below. Requests related to your medical records should be directed to our office directly and will be handled in accordance with applicable law and our HIPAA policies.

10. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site outside of the context of pediatric care requested by a parent or guardian.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Policy.
